Terms of Service

These Terms govern your use of the Phoenix mobile app and the phoenixbreakup.tech website (together, the "Service"). By using the Service you agree to them. If you do not agree, please don't use the Service.

1. What Phoenix is — and isn't

Phoenix is a self-help companion for people recovering from a breakup: daily quests, a no-contact streak, progress tracking, and an AI conversation partner.

Phoenix is not therapy. The Service does not provide medical care, mental-health treatment, diagnosis, or emergency services, and is not a substitute for professional help. If you are in crisis or danger, contact local emergency services, call or text 988 (US), or visit findahelpline.com.

2. Eligibility

You must be at least 16 years old to use Phoenix. By using the Service you confirm that you meet this requirement.

3. Your account

Phoenix creates an anonymous account tied to your device — no email or password. You are responsible for your device; anyone with access to it can access your Phoenix data. Deleting the app permanently disconnects the anonymous account, and progress cannot be recovered on a new device.

4. AI-generated content

Companion replies and chapter reports are generated by AI. They can be inaccurate, incomplete, or a poor fit for your situation, and are provided for emotional support and motivation only — not as professional, legal, medical, or financial advice. Use your own judgment before acting on anything the companion says.

5. Acceptable use

You agree not to:

use the Service to harass, stalk, monitor, or harm any person, including an ex-partner;
attempt to extract, jailbreak, or misuse the underlying AI models;
reverse-engineer, resell, or interfere with the operation of the Service;
use the Service in violation of any applicable law.

6. Subscriptions and payments

Phoenix offers optional paid subscriptions (e.g. unlimited companion messages), billed through your Apple App Store or Google Play account.
Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period, via your store account settings.
Prices may change; changes apply from your next billing period after notice.
Refunds are handled by Apple or Google under their policies.
XP, levels, streaks, and badges are gameplay features with no monetary value and cannot be exchanged, transferred, or refunded.

7. Intellectual property

The Service, including its design, code, flame artwork, and content (excluding what you write), belongs to Phoenix and its licensors. We grant you a personal, non-exclusive, non-transferable license to use the app for its intended purpose. What you write remains yours; you grant us the limited license needed to operate the Service (store, process, and display your content back to you).

8. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose. We do not guarantee the Service will be uninterrupted, error-free, or that any outcome (emotional or otherwise) will result from its use.

9. Limitation of liability

To the maximum extent permitted by law, Phoenix and its team will not be liable for any indirect, incidental, consequential, or punitive damages, or for loss of data, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim, or USD $10 if you paid nothing.

10. Termination

You can stop using Phoenix at any time by deleting the app. We may suspend or terminate access that violates these Terms or harms the Service or other users.

11. Changes

We may update these Terms as the Service evolves. We'll post updates here and update the date above; material changes will be highlighted in the app. Continued use after changes means you accept them.
